Kodak Black Regains Freedom After Drug Possession Charges Were Dismissed

Black regained his freedom on Wednesday, February 21, following a decision from U.S. District Judge Jose E. Martinez in Miami. As stated, his arrest on drug possession charges violated the terms of his supervised release from an unrelated drug case, which led to him being locked up for two months.

The 26-year-old was arrested in 2022 on charges of trafficking oxycodone and possession of a controlled substance without a prescription. He was freed on bond with regular drug testing as a condition of his release; however, he failed to uphold his end of the bargain.

According to court records, the "Roll In Peace" rapper was ordered to spend 30 days in drug rehab early last year after missing a drug test in February and testing positive for fentanyl several days later.

The situation worsened in June 2023 after authorities reported he did not show up for a drug test and subsequently issued a warrant for his arrest, per USA Today. As stated, Black's release from Miami's jail comes nearly two weeks after his drug possession charge was dismissed in the neighboring Broward County.

Judge Barbara Duffy of the Broward County Circuit in South Florida dismissed the charges. She ruled that prosecutors on Black's case could not disprove the fact that he had a legit oxycodone prescription filled by a pharmacy at the time of his arrest.

Due to this inability to refute or negate that fact, there was no case against the 26-year-old rapper. The drug possession drama began last December when Plantation police found him asleep at the wheel with a white powdered substance around his mouth.

The white powder initially tested positive for cocaine, but further lab tests confirmed it was oxycodone. During the trial, Black's lawyer was able to get the charges dismissed by presenting a valid prescription he obtained from a pharmacy in July 2022.

Additionally, the rapper's attorney, Bradford Cohen, proudly announced the dismissal of his client's drug possession charges on Instagram. He shared a picture of the court papers alongside the caption:

"Motion to Dismiss @kodakblack new case for possession of 'cocaine' that was actually oxycodone….GRANTED. I will leave that right here. We have moved to have his bond reinstated. With my friends for over 20 years, @skywriter.esq and Fred Haddad."

Bradford actively participated in helping Black regain his freedom and wasted no time defending his client last December when his oxycodone prescription was mistaken for cocaine.

Following his arrest in December 2023, Black's lawyer vehemently denied the cocaine allegationsand claimed the "rock" found on the rapper was probably a prescription drug. Cohen shared an emotional statement detailing his longtime relationship with his client and his experience in Federal Prison.

"The job of an attorney is never easy. That statement can be amended to read the job of an attorney who cares about your case, and your well-being is never easy. I have represented @kodakblack since he was a kid," the attorney wrote.

"When he went to federal prison, he was beaten by the guards so badly that he had to be hospitalized at one point," Cohen continued, claiming his client became hooked on prescription drugs following his brutal incarceration. In his words:

"We sued the BOP, but Kodak said he wanted to move forward when he was released and had me drop the case. The injuries from those abuses coupled with the shooting caused him to get prescribed pain medicine."

Cohen noted Black, "like many people across the country," became dependent on those prescribed pills. As for the December drug case, the legal representative stressed that he believed "that the 'rock' this officer found when tested will be a Percocet, not cocaine."

Sources also supported the lawyer's narrative, claiming Black typically carries his prescription medication in a baggie, and it could easily be mistaken as another substance if it is unmarked. An insider noted this was what happened when officers found unlabeled drugs in the rapper's possession.
