him unstable and unhinged. calling intensify for supreme court justice samuel alito to recuse himself from all 2020 election cases before the high court, after pictures of yet another flag used by january 6 rioters and others is seen outside the justice's beach house on the jersey shore. ♪♪ good day, everyone. i'm andrea mitchell in washington. president biden is meeting with kenya's president at this hour. welcomed for a state visit with all the pomp and circ*mstance to signal kenya's importance. mr. biden is designated it a major non-nato ally, something that is for only 18 other countries around the world. other nations fall to military coups.

kenya will send a peacekeeping force to haiti. it has been taken over by armed gangs since the assassination of its president three years ago. in return, kenya is asking for debt relief, most of which it owes to china, as it fights to become a growing technology and innovation hub. we begin with gabe gutierrez. gabe, you spent so much time reporting in haiti. you understand the significance of the peacekeepers there. explain how important today's events are for stabilizing the nation and for the rest of the subsaharan african region. kenya is a shining example of democracy. >> reporter: that's right. haiti is in dire straits with armed gangs controlling about 80% of the capital city. this comes as the u.s. really tries to find a way to help stabilize that country. of course, not pledging any

troops. but a lot of financial help for this, pledging some $300 million. of course, top republicans on capitol hill have been frustrated with the biden administration for what they see as trying to go around congress. administration approved $60 million several weeks ago. there was the multinational force that you talked about that was expected to deploy this week. a u.s. official tells me that that -- that timing for that multinational force is up in the air, but it's believed the procurement of some equipment, including armored vehicles and radios to be able to go with that multinational force that involves about 1,000 police officers from kenya, that that is expected -- the equipment is expected to be procured by the end of the month. that state visit you are talking about, kenya leading this multinational force, volunteering to do it last year, despite domestic opposition in

kenya. the white house sees it as a huge partner, not just in haiti but as you said, really around the world, especially with russia and china gaining influence. >> thanks to gabe gutierrez. you will be seeing the news conference shortly from the president within this hour. thanks, gabe. joining us now democratic senator chris coons of delaware. the former chair of the africa subcommittee and has had many visits to kenya. before we get to kenya, i want to ask you about that, but i want to talk to you about as a member of the judiciary committee that confirmed supreme court justices, "the new york times" produced evidence of another controversial flag used by trump supporters outside another home of samuel alito. they have pictures calling the so-called appeal to heaven or

pine tree flag flying last summer at alito's beach house on the jersey shore. the flag originated during the revolution. in modern times, it's used by far right groups as a symbol of christian nationalism. was carried by the mob at the capitol on january 6. justice alito has not responded to "the new york time." the court did not respond to nbc news. of course, this comes after alito's response to another "new york times" story that's showing an american flag upside down outside the virginia house of the justice. a symbol associated with the stop the steal movement. blaming that on his wife. your committee has been investigating ethical concerns of the court. chairman durbin wants alito to recuse himself from 2020 and january 6 cases. do you agree? >> yes. >> is there movement on the committee? >> we have to do more to make it

clear to the american people that we see this repeated public expression of a political opinion at the home of a sitting supreme court justice as completely inappropriate. i think what we should do is to put on the floor of the senate the supreme court ethics and recusal act and make the members of the senate vote so the public is clear where we stand on this. i have encouraged our chairman to do more on the committee to hold a hearing, to press the chief justice for an answer. this has been a long and difficult few years for the supreme court for their ethical standards. i think it's unfortunate that the justice chose to blame this on his wife. at the end of the day, plys cal displays at the hopes of federal judges and justices are simply not appropriate. >> you won't get -- do you think you can get a majority of votes in the senate?

>> i don't. let's be blunt, andrea. i don't think there are any republican senators who are willing to join us in insisting that the supreme court adopt an ethics code and a recusal standard that is enforceable. we did work hard for several years on trying to get bipartisan movement on ethics and recusal issues. i'm not optimistic that that bill would actually pass the senate. i do think given the limitations our chairman, senator durbin is frustrated at the limitations on our ability to move ahead on this issue without bipartisan support. but i think the average american should understand that we have in the past been able to move legislation that relates to the supreme court. senator cornyn and i moved a bill in the last congress. as a result of reporting in the press that sitting members of the federal judiciary had stock

holdings in companies who were appearing before them. we quickly got bipartisan support for a bill that was signed into law that imposed a standard of disclosure on the entire federal judiciary, including the supreme court, comparable to the stock disclosures that every senator is obligated to comply with. i think the federal judiciary is watching what's happening with the supreme court and is struck by the fact that they're not following the same standards as the rest of the judiciary. that's just conjecture on my part. obviously, that doesn't reflect any direct conversations i have had with any sitting members of the judiciary. but i think it's important that we do everything we can to make clear to the american public that we take seriously the independence and safety and security of the federal judiciary. >> of course, senator whitehouse has been leading the fray on this. you have senator blumenthal --

you have support among klobuchar as well. not the rest of the senate, not a majority. let's get back to today's state visit. you met with the president of kenya. he has welcomed outreach to iran, russia and china. the u.s. needs his help to stabilize haiti and counter russian influence. we have been kicked out of other african countries. chad under pressure because of the migration from sudan, which is in the civil war. kenya is an important ally right now. >> kenya is a linchpin nation in east africa. a democracy. a country that president biden is elevating to a major non-nato ally status. this is a country that is a great security partner in the very tough work we have been doing together in somalia

against al shabab. the president has been contributing to try to resolve civil strife in south sudan and sudan and as you mentioned, kenya stepped forward and has been willing to take on a difficult peacekeeping mission in haiti. we have strong and deep partnerships. he is a pro-free enterprise leader and welcomes technology partnership partnerships. microsoft announced a data center powered by kenya's geothermal energy. there are several other large commercial partnerships being announced. this state visit is a chance for president biden to highlight his advocacy for democracy, his promotion of the free market and capitalist system and the new tools that we have in the united states, like the development finance corporation, to deliver

economic opportunity in the global south on a basis that's more transparent, more fair, has higher standards than chinese lending and chinese investment. many african partners who i have met with say the united states needs to show up and needs to partner. this is our demonstration to the president and the people of kenya that we value their partnership and look forward to being a trust and reliable partner in the years ahead. >> before i let you go, let me ask you about israel. there's a disagreement among aid groups, the pentagon and the white house as to what aid is getting in, even from the expensive pier with our troops there creating that pier, which is not even as good as a land route. israel has just been -- at least recommended for arrests, indictments for among other things denying aid to the people

in gaza. they denied it. netanyahu has denied that. has any of the aid that we have now delivered to that pier gotten in? i know trucks are getting in, but they are being held -- the aid is being held in warehouses. it's not getting to the people who need it. >> look, we have an ongoing humanitarian disaster in gaza. our president, joe biden, and our partners are trying every possible way to get that aid in, get it distributed, get it delivered to the women and children of gaza who are struggling, suffering through famine and hunger. cindy mccain, a dear friend, head of the world food program, and jose andres and other partner organizations, including unicef and catholic relief services and others are trying to distribute aid within gaza. there's critical problems.

de-confliction is something we have told netanyahu. the destruction on the ground in gaza has been catastrophic. this pier built at great expense and it's temporary is helping reduce the humanitarian suffering. not at the rate that we need. israel needs to fully partner with the international community to deliver aid. the best way do that is by achieing a hostage and cease-fire deal with hamas. we have pushed hamas indirectly through qatar and egypt as hard as we can. president biden has been tireless in being attentive to the concerns of the hostage families. there are several, i think eight americans still held. i will remind you, on october 7, hamas carried out a horrific terrorist attack that killed americans as well as people from two dozen countries around the world. there are hostages being held

an aboutface from nikki haley announcing she will vote for donald trump. >> he is not qualified to be the president of the united states. he has gotten more unstable and unhinged. it's not normal to call on russia to invade nato countries. donald trump has done all of that. and more. i put my priorities on a president who will have the backs of our allies. trump has not been perfect on these policies. i have made that clear many, many times.

but biden has been a catastrophe. so i will be voting for trump. >> joining me now, kimberly atkins stohr, brendan buck, and jennifer palmieri. brendan, a couple of months ago she felt no need to, quote, kiss the ring. she said, as you just saw, he was unhinged, a liar. why would nikki haley do this now? he ruled her out as a vice presidential candidate, but is that still in play? >> i doubt it is. i imagine the only reason, she wants to be president some day. she realizes there's no place in the republican party to be a biden voter and be president. i think it's as simple as the fact she's a politician. what's confounding is, she had to know where this was headed.

even after she lost and dropped out, she was continuing to suggest she wanted to lead a new party and rebuild the party. this is not -- shouldn't be news to her there's not backing for that. she was out there on an island the entire time. i don't understand why she -- this is a bigger shock today because she put herself out there so much. i don't know why she walked herself into this bad position. she's feeling very alone. as much as we talk about those nikki haley voters, those aren't nikki haley voters. people don't care about nikki haley. those were anti-trump voters. >> kimberly, when she suspended her campaign, she said it was up to donald trump to earn the votes of those in the republican party and beyond. she reiterated that yesterday. would it be smart for trump to reach out to her? those could be important voters.

is there some way he can bridge that gap. >> i'm not sure that donald trump believes he even needs to reach out to them. to him, nikki haley is someone who lost and is a loser. he is in control of the party. i'm not sure that that is the case. to brendan's point, agree nikki haley realized she had no political home at this point with this gop with trump. i don't find it shocking at all. she was trying to walk some weird line, being critical of trump without totally stepping out of trump's sphere. i was signalled this was coming when before she said she wouldn't kiss the ring, she already did. she said she would pardon trump if she became president. that was a signal that she would not walk away from trump completely. i wasn't expecting her to. i knew that those who voted for her as an anti-trump vote as brendan said would at some point

be disappointed. >> jen, she's getting votes. is there anything joe biden and the democrats should do to make sure they don't become rfk junior votes? >> sure. i think that you will see -- you have seen the campaign do some of that. i think you will see more of that over the course of the summer. the thing for biden is that tranche of republican voters that are open to considering biden because they are anti-trump is growing. there were some in '16. there were more in '20. in '24, you have the group -- the people that voted for trump twice but won't do it again because of january 6. there's a relatively big, growing bigger than it was before, universe of republicans that could consider it. even if 5% of the 20% of republicans that are voting for

nikki haley now go for biden, that could be very meaningful. >> brendan, let's talk about immigration for a moment. from the moment he came down the escalator, he has been denigrating migrants. he did it yesterday claiming those crossing the border are coming in as terrorists and have contagious diseases. the biden white house is scrambling to come up with -- there's a lot going on in the senate to come up with a messaging bill if they can't pass a bill. there's talk that the biden administration is coming up with all kinds of ways to try to hit this issue as soon as the mexican election is over. anything they do by executive order would require support and cooperation from mexico from south of the border.

how does joe biden try to get his arms around the immigration issue, which has been so dominated and -- by non-factual comments from donald trump? >> yeah. the fact that the senate is bringing back up the bill -- the bipartisan bill that failed before, i think it's a demonstration or an acknowledgement they have failed to take back this issue from donald trump. there was a long, painful process in the senate where they pulled together a bipartisan bill to the surprise of a lot of people. republicans walked away from it. that should have been an opportunity for biden and democrats to reset the conversation, take the high ground and talk about who is really to blame for the failure there. the fact that they happened to bring it up again tells me they didn't pull it off. immigration is a top issue. democrats are paying the price on the issue. this is a matter of -- you can talk all you want about it, but in cities across america where

which ends at the end of june, beginning of july. rulings on donald trump's claims of immunity, the abortion pill, guns, a little more than a month to go before the court recesses for the summer. joining us now, two former u.s. attorneys, paul charlton and greg bauer. greg, let's talk about this case. as i understand it, it was supporting the plaintiffs here and overruling a lower court ruling that said race was a consideration and that this was a gerrymandered district for racial reasons. >> that's right. south carolina's argument was that it was -- that the point that the legislature was trying to make, the republicans in the legislature, was to create a more republican congressional district and not a less african american congressional district. that's what a majority of the court found was the case. >> of course, when you create a majority republican district in south carolina, it's more likely to be a white district.

as it turns out, this excluded thousands of black voters from having a majority district. >> that's right. it put them into representative clyburn's district, which ironically makes his district safer. i'm not sure he would say that he needed a safer district. >> i think he could be elected in any case. >> that's right. what a majority of the court found was that there was no evidence that the primary purpose of the redistricting effort by the republican majority in the legislature, was to create a less african american district. >> of course, this helps protect nancy mace, an incumbent republican who holds that district right now. paul, on another front, more delays in florida. no surprise, apparently. that's in donald trump's classified documents case. she held a pre-trial hearing on

walt nada's motion for dismissal claiming that he is being persecuted for not flipping on the former president who still employs him. this is judge cannon. she's being criticize for holding hearings all day on motions that would be quickly dismissed with an order from the bench. what say you? this seems to be foot dragging. we are well past the trial date and she's still listening to pretrial motions and hearing them one by one. >> right. let's begin with the idea of what is selective and vindictive prosecution is. if i'm speeding down the highway and the police pull me over, it's not enough to say, everybody else was speeding and you stopped me, so you must have selected me or it's just vindictive because i was stopped and everybody else wasn't stopped. we know, anybody who has gotten a ticket, that that kind of

defense isn't going to work. you have to show the court that i was selected for prosecution because of my race, because of my political views. the defense here, he hasn't presented any of that. this is a case that should have been on this motion read on the motions alone and never seen the light of day or a hearing. that's true for a number of other motions that are currently before this judge. most of the hearings are unnecessary. most of them before a more experienced, a more practiced judge would have been disposed of on the hearings alone. that's even true for her public handwringing about how difficult this is. every jury instruction has some degree of difficulty. this case, one where, for example, there's an issue of obstruction, those aren't difficult jury instructions. so much of what we are seeing in the public discourse, at least

in the hearings she's having, are in most courts and most federal courts in particular, unnecessary and are never heard in oral argument. >> they don't have a jury yet, greg. when we look at this, we had three hours of arguments just the other day in new york over very complicated jury instructions in a more unusual case, much more complex case, because it's a novel case. judge merchan said he was going to try to come up with jury instruction -- >> the jury don't know anything about the law when they walk in.

>> two lawyers on the jury. >> interestingly enough. very rare in my experience. coming up with jury instructions on the part of the judge with the lawyers' input is part of the job. it's not that complicated. particular instructions can be complicated in certain cases. just getting it done, delivering them in a way the jury can understand them is part of every judge's job in every trial. >> it's usually done at the end of the trial, not before you have seated a jury. >> absolutely. >> she's doing it first. cart before the horse. >> i can't make sense of it. i agree with paul, it doesn't make sense. that case seems to me -- most observers say it could have been tried before november. for whatever reason, the judge seems intent on not letting that happen. >> thank you. red flags. a second symbol of january 6th and christian nationalism seen outside a second home of supreme court justice samuel alito. what leading lawmakers are saying next.

joining me is a former u.s. assistant attorney and navy veteran calling on justice alito to recuse himself. i don't know how much leverage anyone has. i was talking to senator coons. they are putting legislation together coming out of senate judiciary. there aren't votes for these efforts to try to impose ethics or standards on the supreme court justices. how would you get it passed? >> right. it's really shocking that there isn't more of an outcry to see a supreme court justice, who is supposed to be impartial, and to see justice alito, who at one time was considered a fairly thoughtful jurist -- i never agreed with him, but he was not considered to be so -- such a maga extremist republican on the bench, has really been shocking. the flags in both houses. the white christian nationalist

flag at the beach house is really alarming. he has to recuse himself. you cannot be a judge or a justice overseeing a case when you are not at all impartial. i think these flags show, among many other indications, that he is in no way impartial. i have legislation that i have been working on with other members of the house. we are going to continue to work to find a majority so that we can get this passed through some vehicle. it really is important. we have seen too many cases where -- whether it's justice alito or justice thomas, where they are not meeting the ethical obligations of their office. >> on another topic, you have been working on the defense authorization bill. i want to get your reaction to donald trump's false claim that the fbi was locked and loaded, ready to use deadly force against him when they searched mar-a-lago in 2022.

the attorney general said that's completely false. false and dangerous. the same language used in -- by the fbi when they go to a home just to deliver a search warrant. they used it at the president's house as well in wilmington. >> yeah. the president has a history -- the former president has a history of saying a lot of alarming things that are not true. we just have to, i think, continue to move forward in a thoughtful way to bring people together and against the chaos that he continues to try to create in this nation. we just, for example, passed the national defense authorization last night. this is a broad piece of legislation where we fund the ships and aircraft of our nation, the national defense, stand with our allies. what we fought over for hours yesterday in this 12-hour

markup, what we fought over was supporting our people. what i saw there and what i thought was so dangerous was the continued attacks on women. we have seen it across the country when it comes to the overturning of roe that president trump orchestrated. now we see it again in the national defense authorization act as they attempted last night to try to roll back some of the gains we made over 30 years ago, that the house armed services passed over 30 years ago, as i was graduating from the united states naval academy into a fleet where many of the combat restrictions for women had been lifted. we see the republicans now trying to tear down that scaffolding as well. >> it's fleet week. you think about the navy so much. we see this wonderful picture from new york and elsewhere. these efforts to do this to the military -- as a veteran, this has to disturb you, as a graduate of the academy.

hamas is going to do regarding the hostages. what do you see happening as they pick new leaders? >> so the paradox here, andrea, and thanks for having me on -- is this is such a chaotic, dangerous time in the middle east. iran is at the center of so much of the violence and conflict that we're seeing because of its sponsorship of hamas, of the houthis, of proxy militias in syria and iraq, which have attacked u.s. forces. so you have all this chaos that iran is helping to foment, and then you have this incredibly disruptive, sudden event with the death of iran's president and foreign minister. the paradox is that i don't think that much is going to change for a couple of reasons. one is that the real power in

iran is the man i think you had on your screen a moment ago, iran's supreme leader, ayatollah khamenei, but he is the man who really runs the country, and there's kind of a sham democracy in iran where they do elect a president, but those are elections that, you know, are widely discredited as illegitimate, most candidates, many candidates are disallowed from running, and then beyond that, the second reason is that, you know, the entire political establishment in iran, the establishment that really controls the country below the supreme leader is made up overwhelmingly of hard-liners, and by all accounts it appears that the president and the foreign minister will likely be succeeded by like-minded hard-liners. but the last point, which is also sort of paradoxical given all the instability in the region is that iran has been limiting the escalation of these conflicts because it does not appear that iran wants a full-scale full-blown war with israel or the united states.

>> now, of course there's a huge impact on what's happening in israel. the hostage and missing family's forum yesterday released a really disturbing video from october 7th. they wanted to release it to put pressure on for a hostage release. it shows hamas terrorists on october 7th inside an israeli military base with seven female idf soldiers, many covered in blood and bruises. well, i mean, it's just horrific the soldiers are leering and saying really provocative and threatening things to these women. the u.n. has reported that many of the women hostages were attacked sexually and that rape was used as a weapon of war, another war crime horrifically. there's no evidence at all that that took place in that video with this group. we just don't know what was happening, what happened before and after the video, and the pressure for hostage release is

increasing. the goldbergs were here with me yesterday. they met with officials here, they met with the president monday night. they met with members of congress and others did, but netanyahu still is sticking to his goal of eliminating hamas, even though two very prominent members of the war cabinet including his defense minister say that's not possible. where do you see the hostage talks, which are supposedly in pause, stalemated? >> it's not a happy situation, andrea. the outlook for a deal here i think is bleak. it's hard for me to understand where the interests of israel and hamas can overlap in a way where we can have an agreement that releases a substantial number of hostages. maybe it's possible to do this incrementally and get some of the hostages out, but ultimately, the hostages are what are keeping the leader of hamas, yaya sinwar alive.

netanyahu has vowed to kill sinwar and completely wipe out hamas, but the thing -- one of the main obstacles that prevent him from doing that is the fact that these hostages are there and the israeli military has to pursue a strategy that battles hamas while keeping the hostages alive. but when you ultimately go for it, you go for the leadership. you go for sin war, if they can figure out where he is and how to get at him, i don't see how they can do that without harming the hostages. at the same time, netanyahu has ruled out a permanent cease fire and a withdrawal of israeli forces, and that's the marker that sinwar has drawn as his condition for a major hostage release, and there's just not a lot of evidence he's going to budge from that. unfortunately, i think sinwar may believe he's winning this conflict as israel suffers more and more diplomatic isolation around the world. i have trouble understanding how a deal gets done and what it
